This End User License Agreement ("EULA") governs your right to use the Ebbi mobile application. By downloading, installing, or using Ebbi, you agree to be bound by this EULA. If you do not agree, do not install or use the app.
Subject to your compliance with this EULA and Ebbi's Terms of Service, The Forge Hut, LLC ("Forge Hut," "we," "us," or "our") grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Ebbi application ("App") on mobile devices that you own or control, solely for your personal use as permitted by this EULA.
This license is granted to you personally and may not be transferred to any other person or entity. No other rights are granted.
The license granted in Section 1 is limited to personal, non-commercial use of the App on devices you own or control. You may not use Ebbi for any commercial purpose, including but not limited to:
The App is licensed to you, not sold. This EULA does not convey any ownership interest in the App or any associated intellectual property.
You may not, and may not permit others to:
Any unauthorized use immediately terminates the license granted in this EULA.
The App and all copies thereof are proprietary to Forge Hut and title thereto remains with Forge Hut. All rights in the App not specifically granted in this EULA are reserved to Forge Hut.
The Forge Hut, LLC owns all right, title, and interest in and to the App, including all intellectual property rights therein — including but not limited to patents, copyrights, trademarks, trade secrets, source code, design, graphics, user interface, and content. "Ebbi," "Forge Hut," and associated logos and marks are trademarks of The Forge Hut, LLC.
Nothing in this EULA shall be construed to grant you any rights in Forge Hut's trademarks or other intellectual property beyond the limited license explicitly set forth herein.
The App is distributed through third-party platforms including the Apple App Store and Google Play Store. Your use of the App through these platforms is also subject to those platforms' respective terms of service:
In the event of any conflict between this EULA and the applicable app store terms, the app store terms shall control solely with respect to the distribution and payment aspects; this EULA otherwise governs your use of the App.
Apple and Google are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce this EULA against you.
Ebbi offers both free and paid ("Pro") tiers. The scope of your license depends on your subscription status:
All subscription billing is managed through the Apple App Store or Google Play Store. Forge Hut does not directly process payments. For billing support, contact the relevant app store.
This EULA is effective until terminated.
Termination by you: You may terminate this EULA at any time by deleting the App and all copies thereof from your devices.
Termination by Forge Hut: This EULA and the license granted herein will terminate automatically and without notice if you fail to comply with any provision of this EULA or Ebbi's Terms of Service. Forge Hut also reserves the right to terminate or suspend access to the App at its discretion with reasonable notice where feasible.
Upon termination, you must immediately cease all use of the App and delete all copies from your devices. Sections 4, 8, 9, 10, and 11 survive termination of this EULA.
The App is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by applicable law, Forge Hut expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Forge Hut does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected.

To the maximum extent permitted by applicable law, in no event shall Forge Hut, its officers, directors, employees, or licensors be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with this EULA or your use of the App, even if Forge Hut has been advised of the possibility of such damages.
In no event shall Forge Hut's total liability to you for all claims arising under this EULA exceed the amount you paid for the App in the twelve (12) months preceding the claim, or $10.00 USD if you have not made any such payments.

This EULA shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts located in Kansas, and you consent to personal jurisdiction in such courts.
If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
